TERMS & CONDITIONS
These Terms and Conditions apply to all services supplied by Brightwire Electrical Solutions Ltd (“the Company”, “we”, “us”) to any customer (“Client”, “you”).

2. Basis of Contract
2.1 A binding contract is formed when:
You accept our written quotation; or
You instruct us to commence work.
2.2 These Terms apply to both domestic consumers and commercial clients.
Where you are acting as a consumer, your statutory rights are not affected.
3. Quotations & Pricing
3.1 Written quotations are valid for 30 days unless otherwise stated.
3.2 Estimates are not fixed prices and may change depending on site conditions.
3.3 We may revise pricing where:
Unforeseen works are required;
There are material increases in supply costs;
Work is delayed due to client instruction.
3.4 VAT will be charged at the prevailing rate where applicable.
4. Variations
4.1 Any additional or altered work must be agreed in writing.
4.2 Variations may affect price and completion time.
5. Payment Terms
5.1 A deposit may be required before work begins.
5.2 Invoices are payable within 14 days unless otherwise agreed.
5.3 For commercial clients, we reserve the right to charge statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
5.4 We may suspend work where payment is overdue.
6. Consumer Cancellation Rights (Scotland)
6.1 If you are a consumer and the contract is agreed at your home, by phone, or online (distance/off-premises contract), you have the right to cancel within 14 days under the Consumer Contracts Regulations 2013.
6.2 If you request that work begins within the 14-day cancellation period:
You must provide written consent; and
You acknowledge you may be liable for reasonable costs if you later cancel.
6.3 If work is fully completed within the cancellation period at your request, your right to cancel may be lost.
7. Our Obligations
7.1 We will perform services with reasonable care and skill in accordance with the Consumer Rights Act 2015.
7.2 All electrical works will comply with:
Current BS 7671 Wiring Regulations (as amended);
Electricity at Work Regulations 1989;
Applicable Scottish Building Standards under the Building (Scotland) Act 2003.
7.3 Certification will be provided where required upon completion and receipt of full payment.
8. Client Responsibilities
You agree to:
Provide safe access to the property;
Disclose known hazards (e.g. asbestos);
Ensure necessary permissions are in place;
Remove or protect valuables.
We may charge for delays caused by lack of access or undisclosed site conditions.
9. Materials & Title
9.1 Materials remain our property until paid for in full.
9.2 We are not responsible for defects in client-supplied materials.
10. Warranty
10.1 Labour is guaranteed for 12 months from completion.
10.2 Manufacturer warranties apply to supplied materials.
10.3 This does not cover:
Misuse or tampering;
Third-party alterations;
External damage or power surges.
This warranty is in addition to your statutory rights.
11. Limitation of Liability
11.1 We maintain appropriate Public Liability Insurance.
11.2 Nothing in these Terms excludes liability for:
Death or personal injury caused by negligence;
Fraud;
Breach of statutory consumer rights.
11.3 For commercial clients, our total liability shall not exceed the contract value.
11.4 We are not liable for indirect or consequential losses (commercial clients only).
12. Delays & Force Majeure
We are not responsible for delays caused by:
Severe weather;
Supplier shortages;
Regulatory inspections;
Events beyond reasonable control.
13. Data Protection
We process personal data in accordance with:
Data Protection Act 2018

Personal information is used only for contract fulfilment, invoicing, and legal compliance.
14. Complaints
Complaints must be submitted in writing within 14 days of completion.
We will investigate and respond within a reasonable timeframe.
15. Governing Law & Jurisdiction
These Terms shall be governed by the law of Scotland.
Any dispute shall be subject to the exclusive jurisdiction of the Scottish courts.
16. Severability
If any provision is found unenforceable under Scottish law, the remaining provisions shall remain valid.
Acceptance
By accepting our quotation or instructing us to begin work, you confirm acceptance of these Terms and Conditions.
